Terms & Conditions
Every aerial filming job is unique with differing factors that influence exactly how the filming is to be done. For this reason SKYVISUAL prefers to quote on an individual project basis after having discussed the proposed project with the client. Unfortunately it is simply not possible to say what any particular project will cost until we discuss the project and understand what images are required, how they are to be used, what permissions are required from land owners or ATC etc.
There are many variables which may affect the quotation including the time of year, location of shoot, potential weather and other external shooting conditions, associated risk of taking the job on (a power failure over water, for example, would probably result in the total loss of the aircraft) and requirements for any additional Civil Aviation Authority approvals. Flights that take place inside ‘Regulated Airspace’ require to be liaised with the appropriate Air Traffic Control unit. SKYVISUAL cannot be held responsible if ATC permission to fly is not granted. This, under normal conditions, is unlikely to happen except in close proximity to an airfield.
There will be occasions (hopefully rare) when it will not be possible to carry out a shoot. This might be because there are obstructions in the area or because of proximity to a group of people or operating in a confined area or operating over a ‘congested area’. Safety of people, property and the UAV itself takes precedence to the photographic operation. It will not be possible to fly in rain or high winds for these reasons.
Although it can be done, it is not normally possible to fly indoors due to likely loss of satellite coverage required to fly safely.
Damage or loss of the UAV will be charged to the client if flown against the advice of the pilot of the UAV. The pilot’s decision (by law) is final.
PAYMENT TERMS: 14 Days (unless by prior agreement)
We will be happy to discuss any of the above with you in greater detail.
We are happy to provide quotes in writing once we have received a full brief from the Client and have been able to discuss the requirements and expectations of the shoot.
AVAILABILITY, BOOKING & DEPOSIT
Due to the nature of the weather in the UK and nature of filming shoots both SKYVISUAL and the client need to be very flexible when planning any given shoot. Many jobs are booked at the last minute, however the SKYVISUAL pilot must have enough time to do the proper pre-flight checks and ensure that the job can be undertaken safely, adhering to the rules & regulations of aerial filming and our operating licence.
SKYVISUAL is happy to pencil in potential jobs and dates for Clients. However, actual bookings will always take priority. Naturally, if a client has a date pencilled in we will go back to them with first refusal on their proposed date.
SKYVISUAL does require clients to commit when booking services and time. Unless by special circumstances, or if time doesn’t permit, we require 35% of the booking to be PAID IN ADVANCE. Bookings will normally be treated as ‘pencilled in’ until the deposit is paid.
Please note that film or photographs and/or film cannot be handed over to the client until the 35% deposit has been paid.
CONFIDENTIALITY
All enquiries will be treated in the strictest confidence.
POSTPONEMENTS, CANCELLATIONS & WEATHER
Remote controlled aerial filming is naturally affected by the flying conditions. If due to weather (e.g. rain, strong winds etc) and we are not able to shoot we shall not charge the client if we can make alternative arrangements for the shoot to happen at another time. The 35% booking fee is simply transferred to another day when we can shoot.
If the shoot cannot be re-scheduled (which we usually know in advance of carrying out the shoot) we will discuss cancellation policy and potential fees with the Client and come to a fair and reasonable compromise.
If a job is cancelled due to other issues and simply not re-scheduled due to the client no longer requiring our services the 35% deposit will not be refunded unless by a pre-agreement and, if additional costs have been incurred, these will also have to be met by the client.
POTENTIAL USE OF IMAGES & FOOTAGE FOR SKYVISUAL PR & SHOWREEL
We are proud of our work and SKYVISUAL actively promotes its service but we will not publish any footage we shoot until it has been released by the Client. However we do reserve the right to use ANY of our footage for internal promotion, whether this be for inclusion on our showreel for PR purposes or to promote SKYVISUAL. If for any reason this is a problem, we would ask you to kindly speak to us in advance of commencement of filming.
Please remember that the copyright of all images shot by SKYVISUAL remains with SKYVISUAL unless specifically negotiated separately with SKYVISUAL. This will require a transfer of copyright fee to be negotiated. Part of those negotiations will be that SKYVISUAL retains the right to reproduce images and video on the SKYVISUAL website without charge.
